Terms & Condition
This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Guidelines for Intermediaries and Digital Media Ethics Code) Rules, 2021 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the Adiuvo website and mobile/handheld device applications.
Interpretation and Definitions
Interpretation :
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
Definitions:
- “Application” means the software program provided by the Company downloaded by You on any electronic device, named Adiuvo.
- “Application Store” means the digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store), or any other digital store where the Application is downloaded.
- “Affiliate” means an entity that controls, is controlled by or is under common control with a party.
- “Account” means a unique account created for You to access our Service or parts of our Service.
- “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Adiuvo.
- “Country” refers to India.
- “Content” refers to text, images, reviews, or other information posted, uploaded, or made available by You.
- “Device” means any device that can access the Service such as a computer, a mobile phone, or a digital tablet.
- “Service” refers to the Website and Mobile Application providing on-demand personal assistance and related services.
- “Terms and Conditions” (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
- “Website” refers to the official Adiuvo web portal.
- “You” means the individual accessing or using the Service, or the company/legal entity on behalf of which such individual is accessing the Service (including both service recipients and service partners/providers).
Acknowledgment
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms, You may not access the Service.
You represent that you are over the age of 18 years. The Company does not permit individuals under 18 to use the Service independently.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Please read our Privacy Policy carefully before using our Service.
User Accounts and Responsibilities
- When You create an account with us, You must provide accurate, complete, and current information at all times.
- You are responsible for safeguarding the password and One-Time Passwords (OTPs) that You use to access the Service and for any activities or actions under Your account.
- You agree not to disclose Your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
Limitation of Liability and Disclaimer
- The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Adiuvo disclaims all warranties of any kind, whether express or implied.
- We act as an intermediary platform connecting users with third-party service providers. While we conduct verification checks, Adiuvo shall not be held directly liable for the conduct, punctuality, or quality of services rendered by independent service partners.
Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts located in Jabalpur, Madhya Pradesh.
